These Terms of Service ("Terms") govern your access to and use of Affberry ("Affberry", "we", "us", or "our") and the affiliate management platform we provide (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Acceptance of terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Accounts

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

Acceptable use

You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access to any part of the Service, using the Service to distribute malware or engage in fraudulent tracking, click manipulation, or fake conversions, reverse engineering or scraping the Service, or using the Service in violation of any applicable law or third party's rights.

Subscriptions and billing

The Service is offered under Pro and Pro+ subscription tiers, billed on a recurring basis as described at checkout. Fees are non-refundable except as required by law or as expressly stated in these Terms. We may change subscription pricing with advance notice; continued use after a price change takes effect constitutes acceptance of the new pricing. You may cancel your subscription at any time, effective at the end of the current billing period.

Intellectual property

Affberry and its licensors retain all rights, title, and interest in the Service, including all software, design, trademarks, and content we provide. These Terms do not grant you any rights to use our trademarks or branding without prior written consent. You retain ownership of the data and content you upload to the Service, including your affiliate, prospect, and tracking data.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that tracking data will be free of any inaccuracy.

Limitation of liability

To the maximum extent permitted by law, Affberry and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Termination

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a risk to us or other users. You may terminate your account at any time by canceling your subscription. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms will survive termination.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
